This legal challenge accuses these organizations of conspiring to suppress innovative business models and maintain high commission structures that benefit traditional brokers at the expense of newcomers and consumers.
The lawsuit, lodged in the U.S. District Court in Utah, focuses on what Homie describes as a systemic effort by established real estate entities to prevent competitive entry into the market. Central to the lawsuit is the abolition of NAR’s Participation Rule, which previously required listing brokers to offer commissions to buyer brokers. Homie’s complaint aligns with other antitrust actions in suggesting that such policies artificially inflate the cost of real estate services, thus limiting competition and innovation.
Homie alleges that it has been the target of both overt and covert boycotts. Specific incidents cited in the lawsuit include text messages from agents who explicitly refused to show Homie listings unless higher commissions were offered.
